You are required to read this Terms of Use of the MMF User Agreement (hereinafter "User Agreement") thoroughly. By visiting the MMF domain and accessing and using the MMF web site and any pages contained herein, you agree to the terms and conditions as outlined and written below.

IF YOU NOT AGREE TO THE TERMS OF THIS USER AGREEMENT IN ITS ENTIRETY YOU ARE NOT TO ACCESS THIS SITE.

Mexico Mortgage Marketplace, S. de R. L. de C. V. operates the web site www.MexicoMortgageFinder.com and other affiliated and subsidiary web sites.

For purposes of this User Agreement, "MexicoMortgageFinder (MMF)" means Mexico Mortgage Marketplace, S. de R. L. de C. V. .

SECURITY POLICY

MMF uses the latest security technology to protect your data and transmissions between yourself, MMF, US, Mexican, Canadian and EU banks (pertaining to your use of the ML site), mortgage bankers, mortgage lenders, and retail/wholesale mortgage loan brokers who offer their services as part of the MMF web site (collectively "Lending Sources").

Although MMF has implemented prudent and appropriate safeguards and uses its best efforts which ensure that any personal information you provide as part of your use of this web site is transmitted and disclosed strictly in accordance with your specific instructions. In spite of these numerous technological safeguards, MMF cannot and does not warrant or otherwise guarantee that any personal information you provide as part of being a user of this web site will not be intercepted by a third party and, in turn, potentially decrypted.

LOAN MATCHMAKING SERVICES

MMF offers two basic services as described below:

  1. The MMF "Mexico Loan Match" is the process which occurs when you, the User, enters criteria about the loan type you are looking for and, in turn, get matched with MMF marketplace Lending Source(s). In this service you, the site User, request to be contacted by a member of the MMF marketplace for the purpose of obtaining additional information relating to the loan you found during the MMF "Mexico Loan Match" process.
  2. MMF also offers the User the opportunity to pre-qualify for a loan that they have found using MMF "Mexico Loan Match" process. If you opt to pre-qualify for a loan, you will be asked for more detailed information pertaining to your historical credit history.

MMF WILL NEVER ASK FOR YOUR SOCIAL SECURITY NUMBER OR OTHER SPECIFIC TAX PAYER IDENTIFICATION NUMBER, NOR IS PROVIDING YOUR SOCIAL SECURITY NUMBER OR OTHER SPECIFIC TAX PAYER IDENTIFICATION NUMBER A PRE-REQUISITE FOR OBTAINING ADDITIONAL INFORMATION ABOUT A LOAN WHETHER YOU CHOOSE TO BE CONTACTED BY A LENDING SOURCE AND/OR PRE-QUALIFY FOR A LOAN.

Because MMF loan matches are generated from a sub-set of data information fields from the full User profile contained in the MMF database, the Lending Sources in the MMF Lending Marketplace may require additional credit information in order to be able to provide full loan details and complete the loan application process. You agree and understand that MMF has nothing do to with and is in no way involved with your relationship with any lender and/or broker you are matched with as part of the MMF "Mexico Loan Match" process.

By choosing either MMF service option as described above, you understand that you have provided voluntarily all of the information in your search for a loan match, and said information you, the User have provided, is both accurate and truthful. By providing information to find a loan match through the MMF "Mexico Loan Match" process and by submitting your request for contact and/or pre-qualify form, you implicitly agree to and accept all terms container in the MMF User Agreement.

Mexico Mortgage Marketplace S. de R. L. de C. V. may solicit multiple offers through its network of independently owned and operated lending sources (U.S. Mexican, Canadian and EU based banks, mortgage lenders, retail and wholesale mortgage brokers and other companies which offer home financial mortgage products in Mexico). In order for the MMF "Mexico Loan Match" process to match Lending Sources with the information provided by you, the site User, Lending Sources, as part of their agreement with MMF, provide us initially, and ongoing, periodically with specific criteria about loan types (purchase, refinance, construction, condo-specific, fractional, commercial and/or developer loan) they offer and both eligibility and credit criteria required for specific qualification (including but not limited to the Mexican state where the User is purchasing property, the country of citizenship of the User and/or creditworthiness) for each loan represented and displayed on the MMF site. Each member of the MMF Lending Source marketplace also provides us with the loan and User credit profiles they are interested in receiving.

Mexico Mortgage Marketplace S. de R. L. de C. V. provides the information entered voluntarily by you, the site User, to its Lending Sources whose criteria that they have provided MMF as described above, match the loan type and credit profile provided by you, the site User.

MMF uses its best efforts to provide current information on its web site and that said information is both accurate and reliable; however, the Lending Source will update you with the most current information pertaining to your loan match upon making contact in the way you, the site User, have requested and specified. Be aware that MMF reserves the right to make changes and updates to the information provided on MMF or affiliate web sites and may be made by MMF at any time without notice to the User. ALL OF THE INFORMATION CONTAINED ON THIS WEB SITE AND THE PROPRIETARY CODE, SOFTWARE, PRODUCTS AND SERVICES ASSOCIATED WITH THE MMF AND AFFILIATE WEB SITES ARE PROVIDED ON AN "AS IS" BASIS. MMF AND/OR ITS PARTICIPATING LENDING SOURCES OFFER SPECIFIC DISCLAIMERS REGARDING ANY GUARANTEE, IMPLICIT OR IMPLIED, OF ANY KIND, PERTAINING TO ALL MATTERS RELATING TO THE MMF OR AFFILIATE WEB SITES. USE OF THE MMF OR AFFILIATE WEB SITE AND/OR ANY SERVICES PROVIDED BY MMF IS AT YOUR OWN RISK. MMF AND/OR ITS PARTICIPATING LENDING SOURCES, ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OR OTHER INJURY ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE MMF OR AFFILIATED MMF WEB SITE.

INDEMNIFICATION

As a condition and part of your use of the MMF web site, you agree to indemnify MMM and participating Lending Sources from and against any and all liabilities, direct and indirect expenses (including attorney fees) and any damages that may arise out of claims resulting from your use of the MMF, or affiliate MMF web site.

THIRD PARTY LINKS

The MMF web site contains links to web sites owned, operated and maintained by third parties. These links are made available for User reference only. MMF has no involvement in the operation, nor do we have any control with respect to any information, products and/or services offered on linked web sites. MMF does not endorse services, express or implied, of any linked web site or the web site's owner.

TECHNOLOGICAL CHALLENGES AND WEB SITE DELAYS

MMF is in no way responsible for errors, delays or other technological challenges that may occur while responding to a request for contact or pre-qualify form caused when the User provides an incorrect e-mail address or telephone number, or any other technology related problems and issues beyond MMF's reasonable control.

OTHER TERMS

The MMF User Agreement represents the complete understanding and the entire User Agreement between you, the site User, and MMF, and furthermore it supercedes any and all agreements, expressed, implicit or implied, between you and MMF with respect to the MMF web site. This User Agreement shall be interpreted by and construed in accordance with the laws of the State of Jalisco, MEXICO. If any part of this User Agreement is deemed to invalid, then the specific clause deemed invalid or unenforceable will be recognized as superceded by a valid and enforceable provision that most closely represents the intent of the original User Agreement provision, and the remaining terms of the User Agreement will continue to be in effect and continue to bind both parties.
